DISTANCE SALES AGREEMENT
ARTICLE 1 – PARTIES
SELLER: the party identified above.
BUYER: the consumer whose name, address and contact details are stated in the
order form.
ARTICLE 2 – SUBJECT
The subject of this agreement is to set out the rights and obligations of the parties, under Turkish Consumer Protection Law no. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product ordered electronically by the BUYER from the SELLER's website lamuahome.com.
ARTICLE 3 – PRODUCT AND PAYMENT
The type and quantity of the product, its VAT-inclusive sale price, the shipping cost and the method of payment appear on the order confirmation screen and in the order e-mail sent to the BUYER, and form an inseparable part of this agreement.
ARTICLE 4 – GENERAL PROVISIONS
4.1. The BUYER accepts that they have read and understood the preliminary information on the
essential characteristics of the product, its sale price, the payment method and delivery, and
have given the required confirmation electronically.
4.2. The product is delivered to the address given by the BUYER, not exceeding the statutory
period of 30 days.
4.3. If the product is to be delivered to a person other than the BUYER, the SELLER cannot be
held responsible if that person refuses to accept delivery.
4.4. The BUYER is obliged to inspect the product on delivery, to refuse a damaged product
(dented, broken, torn packaging and similar) from the carrier and to have a report drawn up.
A product accepted on delivery is deemed to be undamaged and intact.
4.5. If supplying the ordered product becomes impossible, the SELLER informs the BUYER and
refunds the amount collected within 14 days at the latest.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw within 14 days of receiving the product, without giving a reason. Once the withdrawal notice reaches the SELLER, the product is taken back and the price is refunded within 14 days. The product must be unused and in resalable condition. The right of withdrawal cannot be used in the cases listed in article 15 of the Regulation (products made to personal specifications, products that cannot be returned for reasons of hygiene).
ARTICLE 6 – COMPETENT COURT
In the application of this agreement, up to the value announced by the Turkish Ministry of Trade, the Consumer Arbitration Committees and Consumer Courts at the place where the BUYER purchased the product and at the BUYER's place of residence are competent.
ARTICLE 7 – ENTRY INTO FORCE
When the BUYER completes payment for the order placed through the site, they are deemed to have accepted all the terms of this agreement. The agreement enters into force upon the BUYER's electronic confirmation.
